1 | Definitions & Scope
Seller
Living History Sdn Bhd, trading as The Living History Project (TLHP), SSM No. 202301015386, 38-3 K Residence 156, Jalan Ampang, 50450 Kuala Lumpur.
Buyer
Any individual who purchases the TLHP Gold Coin through TLHP's official online store at thelivinghistoryproject.com.my/gold-coin.
Scope
These Terms govern the purchase of the TLHP Gold Coin exclusively. They do not apply to any other TLHP merchandise. These Terms are incorporated into and should be read alongside TLHP's site Terms & Conditions.
Calendar days
References to calendar days throughout these Terms mean consecutive days including weekends and public holidays.
2 | Product Description & Accuracy
Accurate description
TLHP represents that all product descriptions, material specifications, and imagery on the product listing page are accurate and complete at the time of publication, in compliance with the Trade Descriptions Act 2011.
Commemorative nature
Where a product is described as commemorative, limited-edition, or collectible, it carries no representation of investment value, financial return, or guaranteed resale market. The buyer acknowledges this in full.
Gold Coin specific
The TLHP Gold Coin is a 0.2g, 999.9 purity gold wafer produced by Habib Jewels, set in an acrylic housing. Each coin is accompanied by a numbered envelope bearing a unique serial number from 1 to 100. It is not legal tender, not investment-grade bullion, and not a financial product. Buying it is not a financial investment.
3 | Orders & Payment
Order confirmation
An order is confirmed upon TLHP's issuance of a confirmation email and receipt. Until that point, TLHP reserves the right to decline or cancel any order.
Authorised channels
Sales are conducted exclusively through thelivinghistoryproject.com.my/gold-coin. TLHP has not authorised any third-party agent, reseller, or individual to sell its merchandise. Purchases through any other channel are made entirely at the buyer's own risk and TLHP bears no liability for such transactions.
Payment methods
TLHP accepts Credit Card, Debit Card, FPX, and e-wallet via its official payment gateway. No other payment methods are accepted. Directing a buyer to pay outside the official checkout constitutes an unauthorised transaction.
Sales final
All sales are final upon confirmed payment. No cancellation is permitted after payment except where TLHP has made an error (e.g. wrong item dispatched).
Delivery address
The email address and delivery address submitted by the buyer at checkout are the buyer's sole responsibility. Any correction must be submitted to goldcoin@thelivinghistoryproject.com.my within 24 hours of placing the order. After this window, TLHP cannot guarantee that communications or delivery will reach the correct destination, and bears no liability for receipts, notifications, or goods dispatched to the details on record.
4 | Pre-shipment Inspection
TLHP's commitment
Every order is personally inspected by a designated TLHP team member before dispatch to verify that the correct item has been selected, that it is in good condition, and that all accompanying items are included.
5 | Delivery & Risk
Delivery
Orders will be dispatched to the buyer's stated delivery address within 14 calendar days of confirmed payment. TLHP will arrange delivery via a courier of its choosing.
Risk transfer
Risk of loss or damage passes to the buyer upon handover to the courier. TLHP is not liable for loss, delay, or damage occurring during transit.
Buyer's unboxing recommendation
TLHP strongly recommends that all buyers film the unboxing of their delivery in a single, uninterrupted take. This is standard practice for valuable goods. In the event of any claim relating to the condition of goods on receipt, contemporaneous unboxing footage is the most reliable means of establishing the item's condition at the point of receipt. TLHP reserves the right to decline any claim where no such footage is available.
Claim window
Any claim relating to the condition or non-receipt of goods must be raised with TLHP within 7 calendar days of confirmed receipt or expected delivery date. No claim will be considered after this window.
6 | Returns, Exchanges & Refunds
Gold Coin — no returns or exchanges
The TLHP Gold Coin is strictly non-returnable and non-exchangeable under all circumstances. No exceptions are made for change of mind, gifting circumstances, or subjective dissatisfaction. If you have any concerns about your purchase, please reach out to us at goldcoin@thelivinghistoryproject.com.my.
Refund process
Where TLHP determines that a refund is warranted, refunds are issued via direct bank transfer to the buyer's bank account at the purchase price as per the official TLHP receipt. TLHP initiates the transfer within 14 calendar days of written confirmation of approval. Buyers should allow a further 7–10 business days for funds to reflect — this is governed by the buyer's bank and is outside TLHP's control.
7 | Authenticity & Authorised Channels
Authentication
Every TLHP Gold Coin is issued with a Certificate of Authenticity and a unique serial number from 1 to 100. If you have any questions regarding your certificate or serial number, please contact us at goldcoin@thelivinghistoryproject.com.my with your order reference.
Unofficial channel disclaimer
TLHP bears no liability of any kind for products purchased outside its official store. Buyers who purchase from unofficial sources do so entirely at their own risk and have no recourse against TLHP.
Secondary market
TLHP is not party to and accepts no responsibility for any secondary market transaction involving TLHP merchandise, regardless of price or representation made by any third party.
8 | Liability
Limitation
TLHP's total liability to any buyer in connection with a merchandise purchase is limited to the purchase price paid for the specific item in dispute. TLHP is not liable for any indirect, consequential, or incidental loss.
Unofficial channel
TLHP accepts zero liability for any claim arising from a purchase made outside its official channel, regardless of representation made by the seller.
Indemnity
The buyer agrees to indemnify and hold harmless Living History Sdn Bhd against any claim, loss, or liability arising from the buyer's misrepresentation of the Gold Coin's nature, unauthorised resale, or breach of these Terms.
9 | Personal Data
PDPA
Personal data collected during purchase is processed in accordance with TLHP's Privacy Policy and the Personal Data Protection Act 2010 (Malaysia).
10 | Governing Law & Disputes
Governing law
These Terms are governed by the laws of Malaysia. All disputes are subject to the exclusive jurisdiction of Malaysian courts.
Complaints
Complaints should be directed to goldcoin@thelivinghistoryproject.com.my with the relevant order reference. TLHP will respond within 14 calendar days.
Amendments
TLHP reserves the right to amend these Terms at any time. The Terms in force at the time of purchase govern that transaction.
